We assist a world-leading online ticketing company in criminal proceedings initiated by one of the world’s largest venue operators and concert organizers. Topics involved are EU freedom to provide services, lack of TRIS notification, and ISP-liability topics. We coordinate with counsel in multiple EU-jurisdictions.

Digital Society (Strategy roadbook) – Digital Services Act (DSA)

We assist a leading EU trade federation in the area of online entertainment, in making a roadbook for its members on how to interact with local authorities and with leading online intermediaries (in particular platforms and VLOPs).

Digital Copyright – Digital Single Market Copyright Directive (DSM)
Industry segment:
TV streaming and videogames
We provide legal counsel to a leading independent streaming provider and to Videogames Europe and Belgian Games (EU and Belgian sector federations) in a challenge before the Belgian Constitutional Court of the Belgian law implementing the DSM Directive. We coordinate with counsel of other intervening parties and with counsel in other jurisdictions.

International Sanctions – EU Regulation 269/2014

We have won a landmark case before the highest Belgian administrative court against the Belgian Government. We assisted a company that was allegedly under control of a Russian entity mentioned on the sanctions list. We coordinated with Austrian counsel as well as with local counsel that we delegated subsets of work to.

We represent the European federation of professional football players in several litigations before the Court of Justice (“CJEU”).
Our team has also acted before the CJEU in cases relating to environmental liability.

We have advised companies and performed multijurisdictional analysis relating to various aspects of EU environmental law, such as waste disclosure requirements, waste take-back obligations, under the EU WEEE Directive, Packaging and Packaging Waste Directive, and Batteries Directive. We have also assisted clients in relation to the Single-Use Plastic Products Directive and successfully managed to have their products not listed as prohibited under the Directive.
In addition, we regularly advise clients in relation to product safety issues, and recall.

EU Regulatory – Radio Equipment (RED)

We have been involved in landmark litigation regarding the CE-marking requirements for refurbished iPhone devices imported from the USA and Asia.

– Clothing companies
We have been asked to advise multinational companies, active in various sectors, including electronic equipment, medical devices, e-cigarettes, on the presence of hazardous substances in their products and the compliance of their products with the EU REACH Regulation, EU PoPs Regulation, and RoHS Directive.
In addition, we have also assisted multinational companies active in the textile industry on ESG issues, related to the display of sustainability label on their products (so-called “green claims”) and the compliance of these labels with the EU rules on green claims. Our assistance has also covered methods to determine the greenhouse gas emissions of companies and their products.

We work together with international trademark holders and trademark representatives on opposition and annulment proceedings before the GCEU, as well as regarding national litigation strategies – with due regard for elements of private international law (e.g. cross-border injunctive relief, anti-suit injunction, etc).

We have significant experience in reviewing, negotiating and drafting tender documents, teaming agreements, OEM agreements, NATO Basic Ordering Agreements, and framework agreements both with end users (NATO and MoDs), system integrators and software vendors.
NATO contracting being subject to Belgian law, we can advise on legal aspects of doing business with NATO.

We have extensive experience in cross-border Digital Twin transactions, especially data acquisition and data curation.
We have for instance coordinated with local counsel in Italy and the Netherlands regarding the Italian fiber telecoms project and related Digital Twin.
We have also advised on the conflict between geospatial (OGC) standards, competition law and IP.

EDSON’s international team consists of Partners Pieter Paepe and Christoph De Preter as well as Counsels Lucas Falco and Judith Bussé. Prior to starting EDSON, they have all practiced at premier national and US law firms. Our team’s language capabilities include Dutch, English, French, German and Italian. They have a strong academic record with postgraduate degrees, affiliations as research assistants with renowned universities and international publications on their name.
